Trial date to be set for truck driver involved in fatal crash

OGALLALA — Nearly a year after a crash on Interstate 80 killed six people, the semi-truck driver in the crash was absent from his hearing on Friday at Keith County District Court. Tony Weekly, 54, is expected to appear in court on Aug.

18 so a trial date can be set. At Weekly’s hearing Friday, Keith County Attorney Randy Fair, who has objected to many of past continuances in the case, told the court he wants Weekly in court “to be advised of the trial date.”

Fair plans to question those at trial such as traffic reconstructionists from the July 31, 2016, accident, which took place near Brule. He told Judge Richard Birch that to do so, Weekly needs to know when his trial is. Weekly’s attorney Gary Krajewski pointed out that Weekly lives in Florida.

“I don’t think it’s an inconvenience for him, given the nature of the charges,” Fair said, referring to six counts of felony motor vehicle homicide. Weekly was driving through a construction site when his semi hit a minivan and killed a family of five. Jamison and Kathryne Pals, of Minnesota were killed in the crash, along with their children, ages 3, 23 months and 2 1/2.

Another man, Terry Sullivan, of Denver, would later die of his injuries.

Officials at the scene said Weekly was driving too fast and negligently.
