The man screams back “move out the way then” but Mr Barrett tells him “not to take the high and mighty” when he’s parked in a space for parents and children. The couple and Mr Barrett then exchange heated words and argue whether or not the woman was told to “p*** off” or just “to p*** off out of the space.”? Mr Barrett gets back in his car and they exchange a few more words between them before a Tesco security guard comes over and things suddenly simmer down.

Mr Barrett tells him: “I was just waiting for them to say sorry instead of have an attitude for parking in the wrong blooding place.”

The security guard tells him he “understands his point” to which Mr Barrett replies: “I’ve proved my point and I’ve filmed them – I’ll get out the way.” The footage then cuts off abruptly. There have been calls in the last two years for drivers who incorrectly park in parent-and-child spaces to be issued on the spot fines of GBP25.

Use of a parking bay in a privately owned car park is a matter of contract law, created by the signs in the car park.

The terms on which certain bays can be used depend on the signs around the car park and how well they are placed. Restricting the use of certain bays to parents with young children is OK as long as the signs are clear and set out that a charge will apply for misuse. So if bays are restricted and effectively reserved for parents with children, anyone else parking there risks a penalty charge notice for parking without permission and is in breach of contract.

However, because motorists know car parks are rarely patrolled, one in ten of us admit to regularly parking in a parent-and-child bay even when they don’t have a child in the car because they’re not scared of getting punished.
